Dear Residents of the Town of Varick:

It is with mixed feelings that I write this report. I had hoped to serve you another four years, but you placed your trust in Bob Hayssen. I wish Bob all the best. If I can help the transition in anyway, I am pleased to assist. Don’t be afraid to ask.

The programs that were initiated during my term will greatly enhance the quality of life in the Town as they are brought to completion. There is still a great deal to be done, the groundwork is in place.

I plan to continue to be active in the town and the county and perhaps serve in a different role in the future.

Over the past several years, we have seen a continual increase in the amount of heavy truck traffic that is traveling through our County on the State highways such as Routes 89 and 96. Due to the sheer volume of this truck traffic, the weight of the trucks, and the excessive speed at which they travel, this traffic poses several problems for our communities. First and foremost, they pose a significant safety concern due to their speed, weight, and the residential nature of many of these roads. Second, the volume of trucks and their weight increase the rate at which these roads deteriorate, once again posing a safety concern, but also creating a financial burden on the taxpayers when repairs have to be made. Third, if involved in an accident, they pose an environmental and health threat to our lakes, streams, and communities. Fortunately for the residents of our community, over the last few weeks, this issue has finally received State wide recognition as a problem that needs to be addressed.

When Seneca Meadows Incorporated wanted to expand their landfill, I knew that getting the trash haulers off Routes 89 and 96 would not be an easy task. I also knew that there would be very little support from Seneca County since so much money was being given by Seneca Meadows to line the pockets of many of the Villages, Towns, organizations, and individuals within the County.

I contacted the Counties of Tompkins and Cayuga and learned that they were experiencing similar issues with the large trash trucks going through their Towns. Although these counties were also adversely affected by the garbage truck issue, there was no money exchange to hush them from raising the issue.

It was announced on October 23, that New York State Senator George Winner, Jr. had co-sponsored a bill which would keep large garbage trucks from hauling waste from New York City and other downstate regions over local highways in Tompkins County and other upstate municipalities. Under the legislation, the New York State Department of Transportation would consult with the New York State Department of Health and the New York State Department of Environmental Conservation when establishing truck route designations. This bill has been approved by the State Senate and is awaiting approval by the State Assembly and Governor Spitzer. Until this bill becomes a law, there are few if any restrictions, outside of New York City, for the transportation of hazardous materials on State highways. This has been a problem that has been especially persistent and noticeable on State Routes 79, 89, 96 and 34.

In the Wednesday, October 31st edition of the Finger Lakes Times the headline read “Trash-Hauling Issues will be Aired Nov. 27”. Several months ago I had contacted Senator Chuck Schumer’s office to voice my concern and to encourage someone from his office to attend the public hearing on the expansion of Seneca Meadows.

The problems caused by trash haulers taking short cuts on Finger Lakes rural roads will be addressed by the Senator’s office. A meeting has been set up by our U.S. Senator for November 27th at 4pm to include in dialogue representatives from Seneca Meadows Incorporated, the New York City Sanitation Department, and the New York State Department of Transportation.

Senator Schumer hopes to place some pressure on New York City Mayor Michael Bloomberg and sanitation officials to force trash haulers to use the Interstate Highway System to get to Seneca Meadows and the Ontario County Landfill. He has proposed using some type of monitoring system to ensure adherence to these approved routes.

Progress takes time and many details and discussions will follow. I am happy to see that Senator Schumer and State Senator Winner have taken the initiative in attempting to solve this important issue for us in Varick. Many thanks for their hard work and effort. I would also like to thank all of our residents who brought this issue to my attention. Your voice of concern on this issue has been heard and I am proud of what we have accomplished. I would encourage everyone to keep bringing forth important issues and concerns to your elected representatives at all levels. Together, you can effect change.

It has been another very busy and important month with many meetings and many things accomplished.

Great news for the residents in the Hamlet of Fayette! Last week we received word that Small Cities have awarded a $600,000.00 grant toward the Fayette/Varick water project. We need another revenue stream of $400,000.00. It will happen. I want to thank Jeff Trout and Stu Brown the project grant writer for their continued steadfast efforts in this project during these past couple years. Working with our neighboring Towns is what is being encouraged by the State Government. The Town of Varick has been able to accomplish just that during the past four years.

The one-day workshop on co-funding for water infrastructure projects with an individual project consultation was very educational. During the individual consultation, I sat at a table with members from several funding agencies such as: New York State Environmental Facilities Corporation, Office for Small Cities, Department of Environmental Conservation, Department of Health, Department of State, NYS Office of the State Comptroller, Energy Research and Development Authority and USDA Rural Development. The agencies that Varick would get money for the Route 89 project will come from the Environmental Facilities Corporation and USDA Rural Development. They are more than willing to help us find the money. If the money is not immediately available, we will be patient and ready when it becomes available. The responses from the mailing to the property owners on Route 89 continue to come. I have had 4 people who either could not afford public water or who had a system of taking water from the lake that opposed the project. It is important to stress, no one is forced to hook up to water.

Two weeks ago I had the opportunity to travel to Albany to attend the Fall Conference of the New York State Association of Counties. One session I attended dealt with shared municipal services. Varick has been ahead of that concept when we joined the four townships to the South to become part of a five Towns Assessment Group. There maybe other places that we can work with our neighboring Towns to accomplish some savings for our taxpayers. Cutting costs in creative ways should be on all of our agendas.

Several important resolutions were passed which directly effect us here in Varick: one was concerning increased recognition of tourism as a major economic engine for our Counties and New York State. The tourists bring tax dollars.

I serve on the standing Committee on Indian Affairs & Gaming, which we proposed and passed the resolution calling for the collection of sales and excise taxes on tribal lands and a resolution calling on the Governor to take any and all necessary action to oppose applications for taking land into trust unless the application is approved by the affected County. It was very fruitful and enlightening working conference.

SUPERVISOR’S REPORT
TOWN OF VARICK

It is time to revisit the Town’s Code of Ethics to see if there needs to be additions and realignment to best serve the people in this Community.

Local government officials are faced with issues that are just as difficult and time consuming as those faced by officials at any level of government. We must make significant decisions that affect directly the lives, property and livelihood of the people in Varick and Seneca County.

Local officials have business and personal relationships in the Town and County. We are faced with potential conflicts and ethics issues. Should a local official participate in a determination when faced with a conflict or abstain? What are the standards whereby elected officials can make these difficult decisions? Should we be sitting as elected officials on these local boards to serve our own agenda, family and friends?

The State law has provided standards in very few cases. There are many areas that are not regulated by State law such as the many applications residents make to our planning board, our zoning board of appeal, town board, and County Board of Supervisors.

There needs to be a balance to avoid conflicts of interests in our duty as public officials while we perform the responsibility of serving in our elected position. Public service is public trust. The question of conflicts of interests involves a balancing act.

Many local officials believe that they can isolate and block out personal interests or conflicts and make decisions only in the public interest. This is not the test. How can an official be sure that his or her decision is not influenced by personal interest? When an official acts in the face of an actual or apparent conflict of interests, that person cannot objectively defend him or herself against charges of improper conduct by the media or the public.

We need to provide a standard regarding nepotism. Allowing family members to work for the same municipality does not present problems. An abuse of office occurs, when a public official uses his or her authority to provide benefits to another family member.

This is the reason I am asking willing Varick Community members to work on a comprehensive code of ethics to provide guidance to elected Varick officials. The code of ethics will provide a prohibition on local officials to use his or her official position to take action which would result in personal financial benefit or other benefit for the official, his/her relatives, clients, an employer or campaign contributor. That official may not deliberate or vote on any matter when faced with conflicts of interest.

The Varick board by resolution will adopt the proposed 2007 code of ethics upon the Committees recommendations. This document will be given each year to all elected officials, appointments and employees of the Town. It will serve as a guide for all Varick officials to follow. The Town will have set in place standards of conduct reasonably expected from each of us to make the Town Varick in Seneca County a great example to follow.

TAXES! The frustration over the high rate of taxes that we have to endure in New York State has made us angry. Just knowing that New York State is number one in the Country with the most taxes collected from its residents makes for a sad state of affairs. This has caused the State to lose jobs because industry and people have left this beautiful State. Of course this has been happening over the course of several years. Hopefully change can happen and we can become known once again as the Empire State.

Let us look on the positive side and be thankful for what we have. This is a great County and for which there is much to be grateful: its lakes, parks, wineries, and farms. The tourists that come here create jobs for people who live here, by staying in our hotels and bed and breakfast establishments, eating in our restaurants, and purchasing merchandise and goods. This also brings money into our County with the taxes collected. Did you know the bed tax in 2006 collected by the County amounted to $145,163.00? Tourism is a given and we need to see that the County continues to support it. We need to move forward and make the best decisions for the generations to follow by protecting what we have here.

Those residing and owning property in the Town of Varick need to know the Town’s tax rate for 2007 is $3.18 per thousand making us having the second to the lowest tax rate in the County. Those within the Town of Seneca Falls pay only $.57 per thousand because they are able to collect taxes from industry that is within their Town boundaries.

Over the past few years Varick has focused on keeping our rate low and will continue to do so in the future. I am beginning to prepare the Town’s Budget for 2008. To the Town Board, I am recommending we give our highway department a 3% increase in salary since they were not given any for 2007. The salaries of everyone else will remain the same unless I hear a strong objection from the Varick Town Board.

Peter Brown, the Seneca County Resource Management Specialist was notified on Monday, June 25 with a phone call from our local representative from the New York State Archives that the Town of Varick Grant for vault rebuilding and indexing will be funded. On July 3, 2007, a letter from the State Education Department awarded Varick a grant in the amount of $8,527.00. It will be nice to clean up our records and discard some of the boxes the Town no longer is required to keep. It might be called “Town Cleaning”.

I will be a attending a one-day workshop on Co-funding for Water & Sewer Infrastructure Projects with a individual project consultation in Rochester, Tuesday, September 11, 2007 at the Crowne Plaza Hotel. The morning session, a general assembly will concentrate on sources of State & Federal Funding for Water & Wastewater projects and Asset Management. The Afternoon Sessions are “Managing/Financing Your Infrastructure” and the last session being on “Project Development Guidance”. There is much to learn and know for our future projects.

Registration is required for the workshops. I would be happy to have any Town Board member or Town resident who is interested in attending this conference to go with me to hear what we can do to get water on Route 89. At the Individual Consultation, which I have scheduled for 3:45 P.M. - 4:30 P.M., I want to know where the Varick/Fayette Water project water stands and what “hoops” we need to go thru to get water for Route 89 residents. I will need to take with me maps, the plans and survey information that we have done thus far for the Route 89.

I am presently working on a Town Newsletter that will be in the mail before the end of August. I am so glad that I am retired from one job so I can concentrate my time being your Town Supervisor.

The Town of Varick has a new website: varickny.com. The link at the right will take you there.

This is a new location for Varick information that used to be on the Seneca County website. You will find contact information for various town officials, meeting dates, and the text of some local regulations. Two new items were added this month. One is the town budget for 2007, the other is a collection of approved town board minutes for 2007.

Supervisor's Report June 2007

It is count down time. One month has passed since my son Aaron has left for Iraq. There are 14 more months before he comes home. I want to thank the Town of Varick for helping to make those months pass quickly. Keeping busy with projects is a great therapy.

Our Townline Road municipal agreement has been signed by all parties and this evening we opened the bids for the project. These opened bids will be given to our project engineer, Jason McCormick who will go over them, and then meet with Varick’s Highway Superintendent, Rick McCulloch on the 12th of June to make their recommendation to the Board. The Town Board needs to set a date for a special meeting to award the bid for the project upon their recommendation.

I had informed you last Board meeting that I would be attending a forum on “Shared Municipal Services”. I am pleased that Varick has been ahead of this kind of networking. We have been a part of the 5 Towns
Assessment Group: Ovid, Covert, Lodi, Romulus and Varick for seven years. We are now at 100% of equalization rate. And we are presently working with the Town of Fayette to open up the Townline Road in a joint effort.

The purpose of the conference was to provide an educational approach to shared municipal services – highlighting advantages, disadvantages and potential political pitfalls in the process of developing shared services. Shared municipal services are intended to save costs and improve quality in the delivery of services to our taxpayers.

The Conference established a learning network with regions comprised of Allegany, Cattaragus, Chautauqua, Chemung, Genesee, Livingston, Ontario, Orleans, Schuyler, Seneca, Steuben, Wyoming and Yates Counties.

Governor Spitzer has established a New York State Commission on Local Government Efficiency and Competitiveness as a part of an effort to streamline government at every level. New York’s local tax burden is the highest in the United States, which negatively impacts the competitiveness and quality of life in our community.

One session focused on the challenges and opportunities of shared municipal services. Then there were concurrent sessions that followed with examples of success stories where this is actually happening and the Municipalities are saving tax dollars. Some of the examples were: County-Wide shared highway programs; in County wide public safety; County-wide code enforcement; County shared health care; County shared water service; shared Judiciary and Court Administration.

Presently Seneca County is trying to decide how they can help the Towns save money thru shared services with the County being the lead agent. If any of you have suggestions, please feel free to get in touch with me. I will pass it on to Sharon Secor and the Board of Supervisors.

The theme for allowing governments and Townships to work together was “Keep Relationships Growing within Townships” The comment that is often made “It has served us well in the past” needs to be changed to “Does it serve you well in the future.”

Supervisor's Report May 2007

I welcome you all to the Varick Town Board meeting. Your interest in the Town and the Town’s business is very encouraging. Just to know that the work that we do for you is noticed and appreciated. We strive for open government. My motto has always been “public service is public trust”. It is a privilege to serve you, along with all the residents who reside in Varick and the remaining people of Seneca County.

Governor Spitzer yesterday signed an Executive Order creating the Commission on Local Government Efficiency and Competitiveness, which will review ways that New York State’s over 4,200 local governments can save taxpayer dollars and become more efficient by sharing services and undertaking regional collaboration. There is a session this month held in Genesee County that I will be attending concerning this issue.

As the Chief Financial and Budget Officer, I will start to look at planning for the 2008 budget. If anyone has concerns and suggestions, I am willing to take your comments into consideration. You know from the past 3 years of performance, we have managed to keep the Town budget increases at a minimum. The Town Board members also pay taxes. We don’t wish to waste your money as well as our own.

So that is why I keep a close look at the vouchers. If there is a bill that I need to further research, that check is not issued until I am satisfied. It is much easier to withhold a check for payment than try to reclaim the money the after the check has been issued. After having talked to our Auditors; Mr. Archibald, Bonadio Group; Michael Kenneally, Attorney with the Association of Towns; Mr. Schuster, State Comptroller’s Office in Rochester; who agreed that after bills are approved by the Board, should be paid. But as Financial Officer, if I have reason to believe that there is misinformation given or something is illegal and more information is needed to justify the payment, I have that right to defer payment.

I am now informing the Board the check to the amount of $10,061.00 has been paid to Allardice & Associates, Inc.
In your packet, you have our Auditor’s report concerning the Summer Recreation Program of 2005 with their observations along with recommendations. You may read this following the meeting, since there is no action needed. The Town Board wishes to thank Gerald Archibald and Kristin Ryan for additional time doing this review.

The Annual Update Document for the Town for the year ending December 31, 2006 has been officially submitted electronically to the Office of the State Comptroller by Kris Ryan, from the Bonadio Group. The AUD that has been compiled by them is not the finalized reconciled year end ledger balances due to certain issues caused by the computer program. Many reports need to be completed with the use of the Town’s bank statements since we cannot rely on the computer program to give us the correct information. A revised AUD will need to be filled with the State.

To complete the 2006 Audit for the Town there are a few items that need to be reconciled. Deb and I are working to get this information to Gerald Archibald and Kristin Ryan.

At the April Town meeting, I informed the Board of a tax incentive for Local Volunteers that is pending in the United States Congress of legislation that would provide tax incentives for our volunteer firefighters. I completed the survey with the information provided to me, and returned it to the Association of Towns.
